YMCA Strong Kids Website – Storyteller Personal Page Acceptance

The YMCA Strong Kids Website (“Site”) is operated by representatives of YMCAs and YMCA-YWCAs in Canada (referred to herein as the “YMCA”). By submitting my story/stories, comments and photos (“Posting”) to be posted on my Personal Page on the Site, I agree to the following terms:

1. All comments and stories are true, factual and original to me.
2. I grant the YMCA a non-exclusive, perpetual license to use, reproduce, copy, publish, advertise, display, post, transmit, modify, and adapt my Posting as is or as may be edited in the YMCA’s sole discretion. I waive my moral rights in regards to any modifications in my Posting in favour of the YMCA.
3. I warrant that I have obtained permission from all individuals (or their parent or legal guardian if a minor) featured in my Posting, including my comments, stories and/or photos, where applicable.
4. For greater certainty I agree that: (i) my Posting may be reviewed by anyone who can access the Site; and (ii) the YMCA has the right but not the obligation to change names, edit my stories/comments and remove other personal identifiers to protect my privacy and confidentiality and the privacy and confidentiality of those involved in my stories/comments.
5. I further grant the YMCA consent to use my likeness as depicted in the photo(s) I submit to my Personal Page. I have permission from any other recognizable person in the photo(s) (or their parent/legal guardian if a minor) where applicable.
6. I grant the YMCA the option to feature my Posting and any portion thereof on the Site’s homepage, as is or as may be edited in the YMCA’s sole discretion.
7. I represent to the YMCA that my Posting, and any portion thereof does not infringe the rights, including intellectual property rights, of publicity or personality, of any third party and does not contain any illegal, harassing, defamatory, deceptive, fraudulent or obscene content or use vulgar language.
8. The YMCA reserves the right, but is not obligated to edit or remove my Posting or any portion thereof if in its sole discretion it determines that my Posting violates any of these terms.
9. I agree to indemnify and hold the YMCA harmless from any liability related to the violation of these Terms by my posting and any actual or alleged infringement of third party rights by my Posting.
10. I may request that the YMCA remove my Posting or any portion thereof from the Site. The YMCA will use best efforts to ensure my Posting is removed as soon as possible. If I have concerns or complaints about Personal Pages or Postings of others I may contact the YMCA at [email protected].
11. I am a resident of Canada over the age of majority in my province or territory of residence or if a minor, I have had my parent or legal guardian read and consent to these terms on my behalf.
